Terms of Use
1. Who we are and what Olhinho does
Olhinho offers reminders, a patch wear timer, playful rewards for the child, history, a diary and a report to take to the appointment.
In these terms, “we” is Jhonata Tenorio, the developer responsible for the app and the data controller under Brazil's General Data Protection Law (Law No. 13,709/2018 – LGPD), and “you” is the legal guardian who uses the app.
2. Olhinho does not replace the doctor
Olhinho is an organization tool. It is not a medical device, does not diagnose, does not recommend treatment and does not replace follow-up with the eye doctor.
Always follow the doctor's guidance. In case of doubt, pain, worsening vision or any symptom, seek professional care.
3. Who can use it
The app must be installed and set up by an adult, over 18, who is the child's legal guardian.
The child may use Kid Mode always under the guardian's supervision. Kid Mode has no ads or links outside the app, and returning to the parents' area is protected by a challenge.
4. Your data stays on your device
In this version, Olhinho does not require sign-up with email or password. All information is stored only on this device, encrypted.
Therefore, if the device is lost or reset, or the app is uninstalled, the data may be lost. You can export a copy of your data at any time in Profile and use that file to restore it on another device. The file is not encrypted: keep it in a safe place.
5. What data we handle and why
We only handle what is necessary for the app to work:
- Child data: name, age and chosen avatar.
- Health data: the prescription you enter (hours per day, covered eye, days of the week, use of glasses), patch wear time, appointment date, doctor's name (optional) and diary notes and photos.
- App usage data: preferences, reminders and unlocked rewards.
This data is used only to organize the routine, send the reminders you set up, motivate the child with rewards and create the report for the appointment.
6. Legal basis and children's data
Health data is sensitive personal data (art. 5, II, LGPD). Therefore, we only process it with your specific and highlighted consent, given as the legal guardian (art. 11, I, and art. 14, §1, LGPD).
All processing of the child's data is done in the child's best interest (art. 14, LGPD): we collect the minimum necessary, we don't use the data for advertising, we don't create behavioral profiles and we don't use tracking tools.
7. Who we share it with
We don't sell, rent or transfer your data. Sharing only happens when you choose to:
- When you send the PDF report to someone, such as the doctor.
- When you export your data and send the file to whoever you choose.
We may also provide data when there is a legal obligation or court order. In this version, no data is sent to servers and there is no international transfer.
8. Security and how long we keep data
The data is stored encrypted on the device, and the encryption key is kept in the system's secure vault.
The data is kept while you use the app. You can delete everything at any time in Profile, with the option to delete all data. If a security incident occurs that may pose a risk to you or the child, you and Brazil's National Data Protection Authority (ANPD) will be notified (art. 48, LGPD).
9. Your rights
As the data subject and legal guardian, you can, at any time (art. 18, LGPD):
- Confirm whether we process data and access the data.
- Correct incomplete, inaccurate or outdated data.
- Request the deletion of the data.
- Receive a copy of the data (portability), with the export option in Profile.
- Know who the data has been shared with.
- Withdraw your consent, in Profile. Without consent, the features that use health data are blocked.
- File a complaint with the ANPD.
Most of these rights can be exercised directly in the app. For the others, contact the data protection officer using the details in section 14.
10. Premium plan
Some features, such as the PDF report and multiple children, are part of the Premium plan. Billing, renewal and cancellation are handled by the app store (Google Play or App Store), under its rules.
You can cancel whenever you want. The Free plan remains available with the timer, reminders and history.
11. Proper use
You agree to enter correct data, copied from the medical prescription, and to use the app only to follow the treatment of the child in your care, not for illegal purposes or purposes that harm other people.
12. Intellectual property
The Olhinho name, the Pipo mascot, the illustrations, the texts and the software are protected by intellectual property rights. You receive a personal, free and non-exclusive license to use the app, without permission to copy, modify or resell it.
13. Liability
We work to make the app run well, but it may have bugs or become unavailable. Reminders depend on the device's permissions and settings.
Decisions about the treatment are always made by the doctor and the family. This does not limit the rights guaranteed by consumer protection law.
14. Changes, contact and jurisdiction
If these terms or the Privacy Policy change in a relevant way, we will show the new version and ask for a new acceptance before you continue using the app.
Questions or requests about your data or the child's: contact Jhonata Tenorio, data protection officer, at nossos.olhinhos@gmail.com.
These terms are governed by Brazilian law. The courts of the consumer's place of residence are chosen as the venue.
